Terms of Service

1. Acceptance of Terms
By accessing or using CrowdPick ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.
CrowdPick reserves the right to modify these Terms at any time. Changes will be effective immediately upon posting. Your continued use of the Service constitutes acceptance of modified Terms.
2. Description of Service
CrowdPick is a platform that allows users to submit polls with two options and receive votes from the public. We moderate all submissions and provide results within approximately 24 hours of poll approval.
The Service is provided "as is" without any warranties, express or implied.
3. User Eligibility
You must be at least 13 years old to use this Service. By using CrowdPick, you represent that you meet this age requirement and have the legal capacity to enter into these Terms.
4. User Accounts and Email
You must provide a valid email address to submit a poll. You are responsible for:
  • Maintaining the confidentiality of your email account
  • All activities that occur using your email address
  • Notifying us immediately of any unauthorized use
5. Poll Submission Rules
Acceptable Content
Submitted polls must be appropriate for a general audience. You may submit polls about decisions, preferences, opinions, or choices.
Prohibited Content
We automatically reject and reserve the right to remove polls containing:
  • Explicit or inappropriate material: Nudity, sexually explicit content, pornography
  • Violence or weapons: Firearms, weapons, graphic violence, disturbing images
  • Hate and discrimination: Slurs, hate speech, hate symbols, discriminatory content
  • Personal information: Overly personal details, private information about yourself or others
  • Illegal content: Content that violates any applicable laws or regulations
  • Spam or solicitation: Commercial advertisements, promotional content, spam
  • Misinformation: Deliberate false or misleading information
  • Copyright violations: Content you don't have the right to use
  • Political content: Partisan political campaigns, candidates, or divisive political issues
  • Religious content: Proselytizing or content intended to promote or attack religious beliefs
  • Bot-generated content: Polls created by automated systems or AI without human review
  • Low-quality content: Blurry images, unreadable text, nonsensical content
This list is not exhaustive. We reserve the right to refuse any poll for any reason or no reason at our sole discretion.
6. Content Moderation and Approval
All submitted polls undergo manual review. We do not guarantee:
  • That your poll will be approved
  • Any specific timeline for approval (though we aim for 24-48 hours)
  • That approved polls will remain live indefinitely
We may remove any poll at any time, with or without notice, for any reason.
7. Intellectual Property Rights
Your Content
You retain ownership of any content you submit. However, by submitting content to CrowdPick, you grant us a worldwide, non-exclusive, royalty-free, perpetual, irrevocable license to:
  • Display your poll on our website and mobile applications
  • Share your poll on our social media channels
  • Use your poll for promotional and marketing purposes
  • Archive and store your content indefinitely
  • Modify or edit content for formatting or display purposes
Your Representations
By submitting content, you represent and warrant that:
  • You own all rights to the content or have obtained all necessary permissions
  • Your content does not infringe any third-party intellectual property rights
  • You have the right to grant the license described above
  • Your content complies with these Terms
Copyright Infringement
You are solely responsible for ensuring you have the right to use any images, text, or other content you submit.
CrowdPick is not liable for any copyright infringement, trademark violations, or intellectual property disputes arising from user-submitted content.
If your content is used without permission, your remedy is against the user who submitted it, not CrowdPick.
DMCA Takedown Requests
If you believe content on our Service infringes your copyright, please send a DMCA takedown notice to contact@crowdpick.net with:
  • Identification of the copyrighted work
  • Identification of the infringing content (URL)
  • Your contact information
  • A statement of good faith belief that use is unauthorized
  • A statement that the information is accurate and you are authorized to act
  • Your physical or electronic signature
8. Voting and Results
Voting Rules
  • Voting is anonymous
  • We implement measures to prevent duplicate voting, but cannot guarantee perfect accuracy
  • Vote counts are approximate and may be adjusted for fraud prevention
  • Voting periods are typically 24 hours but may vary
Results
  • Results are provided as-is and reflect votes received during the polling period
  • We do not guarantee accuracy of vote counts
  • Results are publicly displayed and may be shared
9. User Conduct
You agree not to:
  • Submit false, misleading, or deceptive polls
  • Attempt to manipulate voting through bots, scripts, or other automated means
  • Harass, abuse, or harm other users
  • Violate any applicable laws or regulations
  • Interfere with or disrupt the Service
  • Attempt to gain unauthorized access to our systems
  • Use the Service for any commercial purpose without our permission
  • Impersonate any person or entity
  • Collect or harvest user information without consent
10. Disclaimer of Warranties
The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to:
  • Warranties of merchantability, fitness for a particular purpose, or non-infringement
  • That the Service will be uninterrupted, secure, or error-free
  • That results will be accurate or reliable
  • That defects will be corrected
  • That the Service is free of viruses or harmful components
YOU USE THE SERVICE AT YOUR OWN RISK.
11. Limitation of Liability
To the maximum extent permitted by law, CrowdPick and its affiliates, officers, directors, employees, and agents shall not be liable for:
  • Any indirect, incidental, special, consequential, or punitive damages
  • Loss of profits, revenue, data, or use
  • Any damages arising from your use or inability to use the Service
  • Any content submitted by users
  • Any unauthorized access to or alteration of your data
  • Any conduct or content of third parties
OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM THESE TERMS OR YOUR USE OF THE SERVICE SHALL NOT EXCEED $100 USD.
Some jurisdictions do not allow limitation of liability, so these limitations may not apply to you.
12. Indemnification
You agree to indemnify, defend, and hold harmless CrowdPick and its affiliates, officers, directors, employees, and agents from any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising from:
  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any rights of another party
  • Content you submit to the Service
  • Your violation of any applicable laws or regulations
This indemnification obligation survives termination of your use of the Service.
13. Termination
We reserve the right to:
  • Suspend or terminate your access to the Service at any time, for any reason, without notice
  • Remove any content at our sole discretion
  • Refuse service to anyone for any reason
Upon termination:
  • Your right to use the Service immediately ceases
  • We may delete your data (subject to our archival policies)
  • Provisions of these Terms that by their nature should survive will survive termination
14. Dispute Resolution
Governing Law
These Terms are governed by the laws of New York, USA, without regard to conflict of law provisions.
Arbitration
Any dispute arising from these Terms or your use of the Service shall be resolved through binding arbitration in accordance with the rules of New York City.
You waive your right to participate in class actions or class arbitrations.
Exceptions
Either party may seek injunctive relief in court for intellectual property infringement or unauthorized access.
15. General Provisions
Entire Agreement
These Terms, along with our Privacy Policy, constitute the entire agreement between you and CrowdPick.
Severability
If any provision is found invalid or unenforceable, the remaining provisions remain in full effect.
Waiver
Our failure to enforce any provision does not constitute a waiver of that provision.
Assignment
You may not assign these Terms. We may assign our rights and obligations without restriction.
No Agency
These Terms do not create any agency, partnership, or joint venture relationship.
Force Majeure
We are not liable for any failure or delay due to circumstances beyond our reasonable control.
